General Terms & Conditions of Sale (GTC)

1. PURPOSE AND SCOPE

These General Terms and Conditions of Sale (GTCS) apply to all product orders placed by consumers on the website www.chateaujuvenalvins.com.

They are available at any time on the website and apply to all orders placed through it. By validating an order, the customer fully and unreservedly accepts these GTCS.

These GTCS apply to purchasers acting as consumers and residing within the European Union.

Sales made to business customers are subject to specific terms and conditions.

2. PRODUCTS AND ORDERS

The products offered for sale are those displayed on the website, subject to availability.

SCEA Le Graveyron reserves the right to modify its product range and prices at any time. Products are invoiced at the rates in force at the time the order is confirmed.

If a product becomes unavailable after an order has been placed, the customer will be informed as soon as possible and may, where applicable, receive a refund for the unavailable product.

An order is deemed final only after payment has been confirmed.

3. PRICES

Prices are stated in euros (€), inclusive of all applicable taxes (VAT included), excluding delivery charges.

Delivery charges are communicated to the customer before the final confirmation of the order.

The applicable prices are those displayed on the website at the time the order is placed.

4. DELIVERY

Products are delivered to the address provided by the customer when placing the order.

Deliveries are made within the European Union.

The estimated delivery time is 7 business days from receipt of payment and confirmation of the order, subject to product availability.

In the event of a delivery delay, the customer benefits from the rights provided under Articles L.216-1 and following of the French Consumer Code.

The customer must inspect the parcel and products upon receipt and promptly report any issue to SCEA Le Graveyron. Such inspection does not affect the customer's rights under the applicable legal warranties.

Delivery is free for orders over €80, subject to the conditions indicated on the website at the time of purchase.

Collection of goods directly from the winery cellar is free of charge.

5. RIGHT OF WITHDRAWAL

In accordance with the provisions of the French Consumer Code, consumers have a period of 14 days from receipt of the products to exercise their right of withdrawal, without having to provide any reason and without incurring any penalty.

The customer must inform SCEA Le Graveyron of their decision to withdraw before the expiry of this period, by email or postal mail.

Products must be returned as soon as possible and no later than 14 days after notification of the withdrawal decision.

The direct cost of returning the products shall be borne by the customer.

Reimbursement will be made in accordance with the provisions of the French Consumer Code and may be delayed until the products have been recovered or until the customer provides proof of shipment.

6. PAYMENT

Payment for orders is made using the methods offered on the website.

Payments by credit or debit card are processed through a secure payment system.

Orders are dispatched only after payment has been confirmed.

7. LEGAL WARRANTIES

SCEA Le Graveyron is liable for the statutory warranties applicable to products sold to consumers.

Legal Warranty of Conformity

In accordance with Articles L.217-3 and following of the French Consumer Code, consumers have a period of two years from delivery of the goods to claim for any lack of conformity.

Consumers may request that the goods be brought into conformity by repair or replacement, under the conditions provided by law.

Warranty Against Hidden Defects

If a wine is found to be non-compliant or affected by a hidden defect, the customer must contact SCEA Le Graveyron. Once the issue has been verified, the affected products may be exchanged or refunded in accordance with the applicable legal provisions.

The return costs for the affected products will be borne by SCEA Le Graveyron.

The legal warranty of conformity and the warranty against hidden defects apply under the conditions and within the time limits provided respectively by Articles L.217-3 and following of the French Consumer Code and Articles 1641 and following of the French Civil Code.

8. SALE OF ALCOHOL – PROTECTION OF MINORS

In accordance with Article L.3342-1 of the French Public Health Code, the sale of alcoholic beverages to minors is prohibited.

Customers must be at least 18 years old to place an order on the website.

Alcohol abuse is harmful to your health. Please drink responsibly.

9. CONSUMER MEDIATION

In accordance with Articles L.611-1 and following of the French Consumer Code, consumers may, after first submitting a written complaint to SCEA Le Graveyron and if the dispute remains unresolved, use the services of the consumer mediator responsible for the company, free of charge.

10. FORCE MAJEURE

SCEA Le Graveyron shall not be held liable for any delay or failure to perform its obligations where such delay or failure results from a force majeure event as defined by Article 1218 of the French Civil Code.

11. APPLICABLE LAW

These GTCS are governed by French law.

In the event of a dispute involving a consumer, the consumer may bring proceedings before the competent courts in accordance with the applicable rules of jurisdiction.
